On the Use of of Force or Coercion

01 July 2015 | Pago Pago, American Samoa
Kimball Corson
The central ideas of restraint are to use good persuasion first and never use more force or coercion than is prudent and necessary to reach desired ends. Let me explain. In almost every endeavor there are winners and losers or people who land out in positions of superior or lesser power. Winners and those with power advantages acquire not only a victory or advantage but also a certain liberty in dealing with the losers or the less powerful.

A lawsuit is a perfect example. The scope and amounts of remedies sought can be sufficient or excessive. Simply because you beat an adversary or are in a position of greater power does not require you to use all the force or coercion available or take as much as you can in that context and position. Prudence and restraint are important..

The core idea of restraint is to use only so much leverage or force as is necessary to reach your desired ends, compromising your adversary or opposition only so far as necessary, minimizing his losses. I have fired a legal client for seriously over-reach in this context simply because he wanted to inflict gratuitous injury and loss because we could.

In requiring acceptable behavior from children, the same as true, the parent should use love and persuasion to the maximum extent possible and then coercion or force only to the extent necessary. Breaking a horse is another example. It can range from a real fight with a wild range animal to much persuasion with a well raised one, and then slipping onto his back and riding away. In the first Gulf War, we reacquired the oil fields for Kuwait and stopped. We did not march to Baghdad.

Restraint and prudence are becoming concepts lost on too many Americans. They think the mark of a winner is to take as much as possible regardless of the consequences and noisily laud their victory. It is unfortunate. The better idea for every conflict is to prevail, of course, but to then live and let live, preserve face, not over-reach, be modest and considerate. go no further than necessary and leave everyone standing and as well off as possible.

Kimball Corson: I am a 75 year old solo sailor, by choice. However, I did take on a personable, but high maintenance female kitten, now a full grown cat, named KiKiPoo when she is sweet, or KatKatPo after she has just killed something like a bird or bat. [...]
Extra:
Although I was a lawyer and practiced law with good success for thirty years, creating significant new law, I never really believed in the law, the politics of law or in the over reaching self-interest of most lawyers I met.
