Hillary Clinton and the Applicable Security Law

13 March 2016 | Pago Pago, American Samoa
Kimball Corson
Examples of breaches or violations of security law in regard to classified information includes these --

(1) Failing to properly escort uncleared visitors or allowing improper
access to controlled facilities;
(2) Taking classified material out of the building without proper doublewrap
protection;
(3) Failing to secure containers with classified material;
(4) Storing classified materials in desk drawers or other improper
containers;
(5) Failing to secure computer hard drives containing classified material;
(6) Reading classified material in any public area; and, importantly,
(7) "Placing classified information on unclassified computers" (see 12 FAM 531, paragraph c)

Normally, first time, single, isolated violations do not result in criminal sanctions, only warnings for violations without consequences. For more serious violations, even for the first time, security clearances are almost always revoked. Additionally, civil penalties may be imposed for more serious violations.

Violations involving "intentional or grossly negligent release or mishandling of
classified information," especially where repeated, are more usually subject to criminal penalties. An illustrative list of criminal statutes establishing penalties of fines and imprisonment for the release or mishandling of classified information is set forth in 12 FAM 558 Exhibit 558.

Until the investigation of Hillary's emails is concluded, there can be no determination of what type of sanction, if any, might be appropriate and sought as to her -- civil or criminal. But on the basis of what is known, it is virtually a foregone conclusion she should lose her security clearance which should preclude her from becoming the next president.

About:
Kimball Corson: I am a 75 year old solo sailor, by choice. However, I did take on a personable, but high maintenance female kitten, now a full grown cat, named KiKiPoo when she is sweet, or KatKatPo after she has just killed something like a bird or bat. [...]
Extra:
Although I was a lawyer and practiced law with good success for thirty years, creating significant new law, I never really believed in the law, the politics of law or in the over reaching self-interest of most lawyers I met. Too much exposure to Nietzsche and other good and seriously thoughtful [...]
